Terms and Conditions

 

I.GENERAL PROVISIONS AND DEFINITIONS

  1. These regulations define the conditions of the loyalty program called "La Millou Family" run via the Online Store www.lamillou.com
  2. The Organizer of the Program is Smartino sp. z o.o. with its registered office in Warsaw (code: 02-993) at ul. Syta 78, entered into the Register of Entrepreneurs kept by the District Court for the Capital City of Warsaw Warsaw, 13th Commercial Division of the National Court Register under KRS number 0000383843, NIP: 5213597935, share capital PLN 50,050.
  3. The expressions listed below used in these Regulations should have the following meanings: 
    1. Regulations - regulations of the "La Millou Family" Program,
    2. La Millou or Organizer - Smartino sp. z o.o. based in Warsaw,
    3. Program or LM Family - La Millou Family loyalty program,
    4. Online Store - an online store run by La Millou at www.lamillou.com,
    5. Club Member - an adult natural person with full legal capacity, who is a registered user of the Online Store and additionally registered in the Program on the terms set out in the Regulations; The Club Member may use the benefits of the Program only if La Millou provides the possibility of making a purchase and shipping to that country via the Online Store (in the version intended for that country); the list of countries from which you can make a purchase and order shipping can be found at www.lamillou.com,
    6. Products - all products from the commercial offer available in the Online Store or La Millou stationary store located at ul. Klimczaka 1 in Warsaw,
    7. BOK - customer service office - a contact point through which Club Members and other La Millou customers can obtain all information regarding the Program and sales. BOK can be contacted via the e-mail address: bok@lamillou.com
    8. Account - user account of the Online Store.

II.REGISTRATION

  1. Any person wishing to participate in the Program may register as a Club Member, provided that the Account is registered in the Online Store.
  2. Registration of the Club Member in the Program is free of charge and takes place via the Online Store based on two registration methods: (1) when registering an Account in the Online Store in accordance with the Online Store's regulations, (2) after registration, by entering the LM Family tab available at Accounts tab.
  3. In the case of registration in LM Family, when registering an Account, the Club Member is obliged to:
    1. accept the Regulations,
    2. consent to the processing of personal data for marketing purposes, i.e., participation in the Program in the form of personal data such as name and surname, e-mail address,
    3. consent to receive commercial information by e-mail to the e-mail address provided,
    4. choose marketing preferences to be informed about within LM Family, such as: (1) activities in social media and events organized by La Millou, (2) competitions, (3) premieres of new collections and ambassador collections, (4) early access to promotions, (5) individualized special offers, e.g., on the birthday of a Club Member’s or his child.
  4. In the case of registration in LM Family after registering the Account, the Club Member is obliged after entering the Account tab:
    1. accept the Regulations,
    2. consent to the processing of personal data for marketing purposes, i.e., participation in the Program in the form of personal data such as name and surname, e-mail address,
    3. consent to receive commercial information by e-mail to the e-mail address provided,
    4. choose marketing preferences that you will be informed about as part of LM Family, such as: (1) social media activities and events organized by La Millou, (2) competitions, (3) premieres of new collections and ambassador collections, (4) early access to promotions, (5) individualized special offers, e.g., on the birthday of a Club Member’s or his child.
  5. If the Club Member indicates that, as part of the benefits offered in the Program, he wants to receive individualized special offers on his or her child's birthday, he/she is obliged to additionally provide his or her child's date of birth. A Club Member may enter no more than 5 dates of birth - 5 of their children. By entering the date of birth of the child, the Club member declares that the date is the date of birth of his child and agrees to the processing of his child's personal data to realize the benefits in the form of sending individualized special offers on his birthday.
  6. The moment of receiving a complete application for participation in the Program by La Millou is treated as the moment of joining the Program.
  7. Providing the Club Member's personal data, such as his e-mail address and name and surname, is voluntary, but necessary to participate in the Program on the terms set in accordance with the preferences. The expression of consents referred to in points II.3.3 b and c and II.3.4.b and c is voluntary, but necessary to participate in the Program, and the expression of consents referred to in point II.3.5. is voluntary and conditions Club Members use of certain benefits.
  8. Each Club Member may only have one Account and register for the Program only once.
  9. After logging in to the Account via the LM Family subpage, each Club Member may e.g., update your data, complete information about yourself, verify your marketing preferences.

 

III. PROGRAM RULES

  1. The Program consists in the Club Member’s access to (1) activity in social media and events organized by La Millou, (2) competitions, (3) premieres of new collections and ambassador collections, (4) early access to promotions, (5) prepared for individualized special offers, e.g., on the Club Member’s birthday or child’s birthday. The club member can independently set what kind of benefits he is interested in.
  2. After joining the Program, each Club Member is entitled to use the extended time to withdraw from the contract of sale of La Millou products purchased through the Online Store to 45 days.
  3. Any benefits resulting from participation in the Program, including discount codes or special offers, will be made available to Club Members via the Account and to the e-mail address.
  4. Each benefit resulting from participation in the Program is limited as to the date, which La Millou informs about when making a given benefit available to the Club Member. If such information does not appear, the benefit is valid for a period of 3 months from the date it is made available to the Club Member.
  5. Obtained discount codes or other benefits reducing the price of products in the Online Store are not combined with other promotions or with each other, unless otherwise stipulated in their content.
  6. The obtained discount codes reduce the price of products in the Online Store, counting from the prices in force in the country from which the Club Member makes the purchase.
  7. La Millou stipulates that different Club Members may receive different benefits at the same time.

 

IV.INTERNATIONAL ASPECTS

  1. The use of benefits provided under the Program is possible within the limits resulting from the regulations of the Online Store.
  2. La Millou does not direct its activities to every country – before realizing the benefits, the Club Member is obliged to verify the possibility of its realization in his country.
  3. La Millou does not ship orders to all countries – before realizing the benefits, the Club Member is obliged to verify the possibility of its realization in his country.

 

V.TERMINATION OF THE ACCOUNT AND TERMINATION OF THE PROGRAM

  1. The Club Member may at any time resign from participation in the Program by submitting a resignation in the form of an e-mail to the address bok@lamillou.com or withdraw the will to participate in the Program by unchecking consent to participate in the Program in the Account settings.
  2. Closing the Account is associated with resignation from the use of accumulated benefits.
  3. La Millou reserves the right to terminate or suspend the Program, which will be announced on the Program Website two months in advance. Club members will also be informed about this, two months in advance via e-mail. During the notice period, Club Members may use all their benefits.

 

VI.COMPLAINTS

  1. Any complaints regarding the Program may be submitted in writing to the address of the Organiser's registered office or by e-mail to bok@lamillou.com throughout the duration of the Program and within 60 days from the date of its completion. The date of the postmark is decisive for keeping the deadline for lodging a written complaint.
  2. The complaint should contain the name and surname, exact address of the complainant, date and place of the event to which the claim relates, as well as a detailed description and reason for the complaint and the content of the request.
  3. Complaints are considered within 14 days of their receipt. The applicants are notified of the consideration of the complaint in writing or, if they submitted the complaint by sending an e-mail, in the form of a return message.
  4. Failure to consider claims under the complaint procedure or the expiry of the period referred to in par. 1 does not infringe the right to pursue these claims in a common court.
  5. The rules set out in this paragraph regarding the method of submitting and content of complaints are informative and serve to improve the complaint handling process, these requirements in no way violate the rights of consumers.

 

VII. FINAL PROVISIONS

  1. The Regulations are available at the Organizer's office and in the Online Store.
  2. Personal data of Program Club Members are processed in accordance with applicable regulations. Detailed information on personal data processed by the Organizer, including on the purposes of processing and the rights of data subjects, are set out in the Privacy Policy available at www.lamillou.com.
  3. The Club Member declares that the personal data provided by him is his data, and that it is true and up to date. Children's personal data provided by Program Club Members are processed until the child's 18th birthday, unless consent to their processing is withdrawn earlier. After the child turns 18, his personal data will be deleted from the Club Member's Account.
  4. If the Club Member acts against the provisions of the Online Store regulations or the regulations for the provision of electronic services in force in the Online Store, the Organizer may, regardless of the consequences of these regulations, limit his access to the Program or deprive him of the possibility of using the Program, provided that his the possibility of using the Account will be excluded or limited on the basis of the aforementioned regulations.
  5. The Organizer reserves the right to change these Regulations during the Program, however, such a change may not violate the rights already acquired by the Program Participants. Club members will be informed about the change in the Regulations at least one month in advance. Information about the change in the Regulations will be sent to the Club Members to the e-mail address provided during registration.
  6. In matters not regulated, the regulations of the Online Store and the privacy policy located at lamillou.com shall apply.
